You only have ten days from the date of your arrest to contest your driver’s license suspension with a formal review hearing.
In Pasco County DUI cases, the arresting officer will take your driver’s license from you if you are arrested and refuse to submit to a blood breath or urine test, or if you do submit but “blow” or test above a .08 BAC. He will issue you a “Uniform Traffic Citation” that will enable you to drive- temporarily. The UTC only allows you to drive for ten days from the date of your arrest. After that, your license will be suspended for at least a period of six months, and potentially much longer, depending on your situation.
However, an experienced DUI lawyer can fight your license suspension by requesting a formal review hearing on your behalf at the Pasco county formal review hearing office. While your DUI lawyer prepares for the formal review hearing, he can get you a 45 day hardship permit to keep you driving after the ten days are up.
The Pasco County formal review hearing is an important part of your DMV criminal case. Your DUI attorney has the opportunity to question and cross examine the State’s witnesses, particularly the officer that arrested you. Importantly, the State Attorney will not be at this administrative review hearing, but your DUI attorney can use the evidence he gathers to help defend you in your criminal case.
However, if your DUI attorney does not request a review hearing within ten days of your arrest, you will lose this opportunity.

Your DUI attorney can appear at your Pasco County Court hearing on your behalf, whether it’s at the West Pasco Courthouse on Little Road, or at the Dade City Courthouse on Live Oak.
