While we enjoy the battle in the courtroom, the truth of the matter is a substantial majority of our clients wish to avoid trial. For many clients, the goal is to keep their record clean of a conviction, with the hopes of ultimately expunging or sealing there record down the road. For other clients the goal is to minimize prison or jail time, whenever possible. However, for a few justice requires an outright dismissal of the charge or a trial by jury.
Criminal Lawyer Strategy: “Play Nice First”
Regardless of your goal, we often advise you to play nice first. While a not guilty at trial will exonerate you, a trial does carry risk: if you lose, the resolution can no longer be negotiated; it becomes up the Judge and the State Attorney. If we can satisfy your goals without going to trial and, then we have reached a successful outcome.
We have a strong working relationship with many of the prosecutors in the area. Attorney Nicole Denmon is a former prosecutor with the 6th Judicial Circuit in Pinellas and Pasco County, and has trained or worked with many of the prosecutors on the other side of the courtroom. She can often negotiate a successful resolution or dismissal before the case even reaches a courtroom.
Therefore, if your goal is to keep your record clean, we will explore pre-trial diversion or try to negotiate a dismissal of the case. If you are a repeat offender or charged with a serious crime, and your goal is to stay out of jail or prison (and dismissal is not a likely alternative), we will attempt to negotiate accordingly.
When the prosecutor does not cooperate: Litigation
When the prosecutor is unwilling or unable to resolve the case in a manner in accordance with your goals, it is time to litigate. When we litigate, we mean we explore and utilize all the defenses available to you in your particular case.

The goal of pre-trial defenses is to get the case dismissed or to get evidence tossed out by the Judge. A prosecutor’s case against you is built on many pieces of evidence. Successfully removing one piece of evidence from his case may be enough to get you the resolution you desire.
