DUI Urine Test Defense: Un-quantified Results
In Hillsborough, Pinellas, and Pasco Counties, a urinalysis is common in cases where the breathalyzer result registers under .08 BAC or the officer suspects DUI by controlled substances. The sample is collected by the arresting officer and sent to an approved lab. Eventually the results are then sent to the State Attorney and used as evidence against the driver. While the urinalysis often shows the presence of a controlled substance in the urine of the DUI driver, it often does not show the amount of the controlled substance in the urine. The results are un-quantified.
With un-quantified results, it will be impossible for a State Forensic Toxicologist to draw an expert conclusion as to whether the individual was under the influence of the controlled substance at the time of the test result.
